Has the world finally hit the height of insanity? It is bad enough that there have been many cases, which some of them have become winners by collecting their winnings from home owners insurance, so of course this causes insurance companies to raise their prices, which then affects other home owners.
The suing disease is very rampid in the United States, which many see the suing thing as a way to receive money, without having to work for it, and it is usually caused by some kind of negligence of their own, that puts them into those dangerous situations, in the first place. Now, I am not saying that this was the case in this situation, but I am saying that there could be a possibility of this, in other suing cases.
The reason that I felt the need to write about this case is because I feel that the court ruling for this particular case is outrageous in many ways. For starters, the 4 year old children were riding their tricycles on the sidewalk, (while they were being supervised by an adult), when an 87 year old lady had apparently ended up in the path of the tricycles.
Don't get me wrong, I agree that it was a tragic accident, because after the trikes hit the lady; she fell and broke her hip, but even though that happened to her, I don't think that she would have sued the children, if her son wasn't a lawyer, because really, who in their right mind would have sued them?
The problem that I have with suing toddlers is that when I was a 4 year old, I had no understanding of what "using good judgment" actually meant, but with that said, I also never tried to intentionally hurt another human being.
One of the problems that are perplexing me about this case is that I am wondering why these children didn't stop pedaling their trikes, when the lady walked into their path. Could it be that when they were riding their trikes, they were riding them side by side, and possibly looking at each other, while they were peddling, when the lady appeared in their path? As I mentioned earlier, the average 4 year old may not be able to understand how to use good judgment.
The other problem that I have is that I am wondering why the supervising parent didn't tell the children to stop pedaling their trikes when the lady stepped into the trikes path, before they came into contact with her. Could it be that the parent was not paying attention possibly because she was talking or text messaging on her cell phone? I suppose we will never know the answer to that one.
